1. Scope of Notice

Kings Education provides English language courses, young learner programs and university pathway programs in the United States. This notice explains how we collect, use, share and protect personal information about students who apply to, enroll in or attend a Kings program in the US, including Kings English, Kings Young Learners and Kings university pathway programs.

"Kings," "we" and "us" mean the Kings entity that runs your program: Prime Education and Training (U.S.A.) Limited, Kings Colleges (USA), LLC, Kings Education (Boston), LLC, Kings NY I LLC or Kings Colleges Wisconsin, LLC. All are part of the Espalier Ventures Limited group.

This notice covers prospective, current and former students.

Pathway programs with a US university: If you are in a program delivered with a partner university, some of your information is also an education record of that university. For that information, Kings acts on the university's behalf under a written agreement, and the university's own privacy notice and FERPA policy also apply to you.

Sensitive information. Some of this information counts as "sensitive" under certain state laws, such as passport and visa numbers, citizenship, and health or disability information. We use it only for the purposes in this table, and we do not use it to infer things about you.

We ask for nationality because immigration documents require it. We do not collect race or ethnicity as a matter of routine. If a survey asks for it, answering is optional.

We collect information from you, your parents or sponsor, partner universities, previous schools, test providers, government systems such as SEVIS, and our staff. We also receive information from:

  • INTO University Partnerships, which hosts Kings US programs on its Partner Portal and supports application submissions. This typically includes identity, contact, education and next of kin information.
  • Education counsellors (educational agents) who act on your behalf, typically identity, contact, education and next of kin information.

When information is required, we will tell you and explain what happens if you do not provide it. For example, we cannot issue an I-20 without your passport details.

3. Immigration reporting for F-1 students

Kings is certified by the Student and Exchange Visitor Program (SEVP) to enroll F-1 students. Federal regulations require our Designated School Officials to keep records about each F-1 student and report them to the Department of Homeland Security (DHS) through SEVIS.

This includes your name, date of birth, citizenship, US address, program dates, enrollment status, transfers, and changes such as early completion or termination. We also respond to lawful requests from DHS, the Department of State and US Customs and Border Protection.

This reporting is required by law. You cannot opt out of it, and we cannot delete records we must keep for SEVP.

4. Education records and FERPA

The Family Educational Rights and Privacy Act (FERPA) applies to schools that receive US Department of Education funding. Kings does not receive this funding, so FERPA does not apply directly to Kings' own records. We follow its core principles anyway:

  • If you are 18 or older, you can see your Kings education records and ask us to correct them.
  • We do not release your grades, attendance or conduct records to anyone else, including parents, sponsors or agents, without your written consent. The exceptions are: government agencies when the law requires it; the partner university you are applying or progressing to; your sponsor where your sponsorship terms require it; a health or safety emergency; and a court order or subpoena.
  • If you are under 18, your parent or legal guardian can also see your records.

If you are a pathway student, the records your partner university holds are covered by FERPA and that university's policy. Kings handles them only as the university directs.

5. Personal information disclosure

We share only what each recipient needs:

  • Partner universities you apply to or progress to
  • Kings group companies, to run admissions, programs and central services
  • INTO University Partnerships, only if you applied through INTO's Partner Portal, so we can provide updates on the status of your application
  • Your education counsellor (educational agent), about your application and enrollment status
  • Your sponsor or fee payer, about payments and, where your sponsorship terms require it, attendance and progress
  • Parents or guardians, if you are under 18, if you consent, or in an emergency
  • Homestay hosts and housing providers: your name, arrival details, dietary needs, emergency contacts and any health information they need to keep you safe
  • Government agencies, including DHS/SEVP, the Department of State, CBP and state agencies, where required
  • ACCET (our accreditor) and our auditors, for quality and compliance reviews
  • Test providers and examining bodies
  • Insurance and medical providers
  • Service providers that run systems for us (student records, CRM, payments, email, online learning, surveys), under contracts that limit how they use your data
  • Law enforcement, courts and child protective services, where required by law or to protect someone's safety
  • Professional advisers, such as lawyers and accountants
  • A buyer or successor, if all or part of Kings is sold or reorganized

We do not sell your personal information. Our websites use cookies, including advertising cookies from third parties. You can switch these off at any time using the cookie settings on our website.

6. Students under 18

  • A parent or legal guardian must sign the application and consent to the program, housing, activities and emergency medical treatment.
  • Parents and legal guardians can see the student's records and ask us to correct them.
  • We do not knowingly collect personal information online from children under 13 without verifiable parental consent, as required by the Children's Online Privacy Protection Act (COPPA). If you believe we have, contact us and we will delete it.
  • We do not knowingly sell minors' information or use it for targeted advertising. Marketing photos or videos of students under 18 need a parent's written consent.
  • Our staff may be required by state law to report suspected abuse or neglect to child protective services.

7. Marketing

We send marketing only where you have agreed to receive it. Every marketing email has an unsubscribe link. We send marketing texts or WhatsApp messages only with your prior consent; reply STOP to end them.

We use your photo or video in marketing only with your consent (see our US consent form and photo release). You can withdraw consent at any time, though we cannot recall printed materials already distributed.

8. Use of Artificial Intelligence (AI) and automated decision-making

We do not make admission, placement, progression or disciplinary decisions by automated means alone. A member of staff always reviews them.

We may use AI tools, including tools provided by INTO University Partnerships, to suggest suitable courses, read and sort documents you submit with your application, and translate messages. These tools support our staff. They do not make decisions about you.

9. Retention of personal information

Record How long
SEVIS and F-1 records At least 3 years after you stop being an F-1 student at Kings
Transcripts and certificates As long as needed to verify your studies, and as our accreditor requires
Financial and payment records 7 years
Applications from students who do not enroll 2 years
CCTV footage A limited period, unless needed for an incident
Marketing preferences Until you opt out

We may keep anonymized information that can no longer identify you for statistics, with no time limit. If you opt out of marketing, we keep a record of that choice so we do not contact you again.

10. How we protect your information

We use administrative, technical and physical safeguards, including access controls, encryption where appropriate and staff training. If a security breach affects your information, we will notify you and any required authorities under applicable state law.

11. Where your information is stored

Your information is held in the United States and the United Kingdom, and by group companies and service providers in other countries. We protect it with contracts and security measures wherever it is held.

12. Your state privacy rights

All students can ask to:

  • See the personal information we hold about you
  • Correct information that is wrong or incomplete
  • Delete information we no longer need, subject to records we must keep by law (including SEVIS records)
  • Withdraw consent you have given
  • Stop marketing messages

Depending on your state of residence (including California, where the law applies to Kings), you may also have the right to:

  • Know what categories and specific pieces of information we collect, use and disclose, and who we disclose it to
  • Receive a portable copy of your information
  • Opt out of the sharing of personal information for targeted advertising, including by switching off advertising cookies on our website
  • Limit our use of sensitive personal information
  • Not be treated differently for using your right

To exercise your privacy rights, email privacy-us@kingseducation.com. We will verify your identity before acting on your request.

Authorized agents: Someone else can make a request for you with your signed permission. We may confirm directly with you that you gave permission.

Time to respond: We respond within 45 days of receiving your request. If we need more time, we will tell you and may take up to 45 more days.

Right of appeal: If we deny your request, you can appeal by emailing privacy-us@kingseducation.com with "Appeal" in the subject line.

California residents: We do not share personal information with third parties for their own direct marketing. We do not knowingly sell or share the personal information of consumers under 16.

13. Right to complain

If you are unhappy with how we have used your information, or we deny a request, please contact our US Privacy Contact first so we can try to resolve it. If you remain unhappy, you can file a complaint with your state attorney general. Pathway students with a FERPA concern about a university can contact the US Department of Education's Student Privacy Policy Office.
